Terms for Evercore API, Uploads and Billing

Review the terms for using Evercore APIs, SDKs, documentation, billing, acceptable use, intellectual property, and service availability.

Data uploaded through Evercore is written to the Arweave permaweb — an immutable, decentralized storage network. Once confirmed, data cannot be deleted by Evercore or any other party. Please review Section 3 before using the Service.

1. Acceptance of Terms

By accessing or using the Evercore API, SDK, or any associated web interfaces (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms apply to all users, including developers integrating via the API, enterprises using Evercore for document storage, and individual users accessing any Evercore interface.

2. Service Description

Evercore is a stateless microservice that acts as an encrypted intermediary for permanent file storage on the Arweave blockchain. The Service provides:

• AES-256-GCM client-side encryption before upload • Arweave transaction management and tag-based metadata • Document versioning via linked transaction chains • API endpoints for upload, download, and version retrieval • Wallet pool management and multi-wallet routing

Evercore operates as an intermediary and does not own or control the Arweave network or the data stored on it.

3. Blockchain Permanence & Immutability

You expressly acknowledge and agree that:

3.1 Permanence. Data written to the Arweave network through the Service is permanent and immutable. Evercore has no technical ability to delete, modify, or retrieve data once it has been confirmed on-chain.

3.2 Public Ledger. All Arweave transactions, including transaction IDs, tags, and metadata, are publicly visible on the Arweave blockchain explorer and GraphQL gateway. While payload data may be encrypted, transaction existence is public.

3.3 Your Responsibility. You are solely responsible for ensuring that (a) you hold all necessary rights to the data you upload, (b) the data does not violate any applicable laws, and (c) sensitive or regulated data is encrypted before submission.

3.4 No Deletion. You may not request deletion of data that has been written to the Arweave network. This is a technical constraint of the underlying protocol, not a policy choice by Evercore.

4. User Obligations

You agree to:

• Provide accurate information when registering for or using the Service • Maintain the security of your API keys and wallet credentials • Use the Service only for lawful purposes • Comply with all applicable laws and regulations, including data protection laws relevant to the content you upload • Not use the Service in a manner that exceeds rate limits or degrades service for other users • Promptly notify us if you suspect unauthorized use of your API key

5. Prohibited Uses

You may not use the Service to:

• Upload content that violates any applicable law, including child sexual abuse material (CSAM), content that infringes intellectual property rights, or material that constitutes defamation or harassment • Upload malware, ransomware, or any code designed to harm systems • Attempt to reverse-engineer, bypass, or circumvent any encryption, authentication, or rate-limiting mechanism • Scrape, crawl, or make automated bulk requests that exceed documented API limits • Resell or sublicense access to the Service without written authorization • Upload personally identifiable information (PII) in plaintext form — all such data must be encrypted before submission • Conduct denial-of-service attacks or any activity that disrupts the Service or the Arweave network

Violations may result in immediate suspension or termination of API access.

6. API Keys & Authentication

API keys issued by Evercore are credentials that authenticate your requests. You are responsible for keeping your API keys confidential. Do not embed API keys in client-side code, public repositories, or any publicly accessible location.

If you believe your API key has been compromised, rotate it immediately via the dashboard. Evercore is not liable for unauthorized use resulting from your failure to secure your credentials.

7. Fees & Arweave Costs

7.1 Evercore Service Fees. Fees for using the Evercore Service are set forth on the Pricing page and may change with 30 days' notice.

7.2 Arweave Network Fees. Uploading to Arweave requires AR tokens to pay the Arweave network's storage endowment fee. These fees are separate from Evercore Service fees and are paid directly to the Arweave network.

7.3 No Refunds for On-Chain Transactions. Because Arweave transactions are irreversible, Evercore does not offer refunds for transactions that have been confirmed on-chain.

8. Intellectual Property

Evercore and its associated source code, documentation, APIs, and interfaces are owned by or licensed to the operators of the Evercore project. Nothing in these Terms grants you ownership of any Evercore intellectual property.

You retain ownership of all content you upload through the Service, subject to the inherent public nature of the Arweave blockchain. By uploading content, you represent that you have all necessary rights to do so.
